Section 2: Are You Eligible for a Pardon?
People seeking a pardon often need to do because either their case is ineligible for expungement or the relief offered by expungement isn’t what they are looking for. This means that there are more offenses that are open to pardon. But it doesn’t mean everybody is necessarily eligible. Eligibility depends on several factors, including:
- A requirement that you were convicted of a crime in Minnesota (felony, gross misdemeanor, or misdemeanor).
- Dismissals, petty misdemeanors, and juvenile adjudications are not eligible for pardon.
- How long ago you completed probation or were otherwise discharged from your sentence.
- Whether you had probation violations (this doesn’t necessarily disqualify you, but it may impact eligibility).
- Whether you have any pending charges.

How long does the pardon process take?
The pardon system is experiencing a backlog of case. The estimates I have received in recent pardon case I am handling is that it will take approximately 12 months. It is not an overnight process. But once the process gets started, we’re in line, and it’s only a matter of time before we get our Clemency Review Commission hearing.
Can all charges be pardoned?
No. Dismissals, petty misdemeanors, and juvenile adjudications can not be pardoned. However, the vast majority of issues people are seeking a pardon are can be pardoned (misdemeanors, gross misdemeanors, and felonies). We can verify in reviewing your record what you are eligible for and not. And even if you are not eligible for pardon, we can explore if you eligible for other relief such as an expungement.
Do I need to appear in person at the hearings?
Not necessarily. Currently, the Clemency Review Commissioner is allowing applicants to appear via Zoom if requested. But understand that this is not a guarantee that the rules and protocol will not change in the future.
