How Transfer DNA Can Lead to False Accusations of Murder: Lukis Anderson’s Case
1. What is murder?
Murder comes in three different degrees in Minnesota (1st, 2nd, and 3rd degree). One of the most common misnomers people have is that to be charged with murder there has to be intent. In Minnesota there are not just intentional murder charges but unintentional murder charges. There are even circumstances where you could not know that anyone had died or even been hurt but still be charged with murder. Knowing precisely what subdivision you are charged under is important in a murder case for crafting the best strategy.
2. What's at Stake?
Everything. Minnesota may not be a capital punishment state. But a murder conviction can result in imprisonment for the rest of your life.
3. What are you up against?
If you look at the caption of the case, it will says the “State of Minnesota v. [Your name]”. It’s not a fair fight. It's one person versus the government. The resources that the State has can be enormous. For example, the Hennepin County Attorney’s Office has a staff of 460 people and a budget of $65 million. What is your budget? I’m guessing not $65 million. Even if the agency charging you is much smaller than Hennepin County, you are still going against a prosecutor's office and police force that is staffed and funded to put people in prison. As an individual against the government, you are an underdog.
4. What's going for you?
Just because you are charged doesn't mean you're guilty. You can take your case to trial. You can challenge the State's evidence and bring forth your own evidence. Do not expect for it to be easy. But you don't need to take your charges sitting down.
I don't need to tell you that murder cases are a big deal. If you are facing murder charges, you likely don't want a lawyer that focuses most of their practice on defending DWI's. The challenges in murder cases are unique and demanding. Peter Lindstrom, Esq. has a certificate in death investigation from North Dakota University. He has also been trained in the science in death investigations from the Death Investigators Training Academy. If charged with murder, you want a lawyer with training for defending you of murder charges, not other lower offenses.
