What are federal crimes?

At a base level, federal charges are based on an alleged violation of federal law instead of state law. But it is essential that you understand that federal criminal defense is a very different animal than criminal defense in state court. The federal government does not mess around. It is more serious from the get go with organizations like the DEA and FBI being much more intensive and organized than local police departments. The United States Attorney’s Office prosecutes cases much more aggressively than prosecutors in state court. And the sentences handed down in federal court are usually significantly longer than in state court.

There are over 5,000 federal statutory crimes. As Justice Neil Gorsuch of the Supreme Court said, “Criminal laws have grown so exuberantly and come to cover so much previously innocent conduct that almost anyone can be arrested for something. Needless to say, this page will not cover every single law. The Federal Government has made that impossible with the proliferation of laws. But because of the nature of how federal and state criminal justice system’s interact, there is a tendency for the majority of federal charges to fit into one of the following five categories:

  1. Drug Crimes
  2. Gun Crimes
  3. Conspiracy & RICO Crimes
  4. Human Trafficking
  5. Child Pornography
