1. What are sex crimes?

In Minnesota, sexual assault is charged under the “criminal sexual conduct” statutes. There are five degrees of charges. 1st degree criminal sexual conduct is the most serious. The maximum penalty is 30 years in prison. Minnesota statute 609.342. 5th degree criminal sexual conduct is the least serious of the criminal sexual conduct statutes. This can be a gross misdemeanor or felony depending on the circumstances. Minnesota statute 609.3451. There are over 56 ways the State can charge criminal sexual conduct within the give degrees.
B. Child Porn
Possession or dissemination of child pornography is a crime. Minnesota statute 617.247. Minnesota is more aware than most states of how false accusations can occur in these case. Famously, Todd Hoffner, the coach of Minnesota State’s football team, had his case dismissed because it was a false accusation. But his dismissal did not come until after he was fired and had his reputation tarnished across the nation.
C. Prostitution
Prostitution is a crime that can range from a misdemeanor to a felony depending on the circumstances. Minnesota statute 609.324.
D. Revenge Porn and Peeping Tom laws
Nonconsensual dissemination of private sexual images is a crime under Minnesota Statute 617.261. This is popularly called the “revenge porn” law. It is most typically charged against people who share private video or photos of people who are nude without their consent. There is also a separate crime of interference with privacy under Minnesota statute 609.746. This statute covers what people popularly refer to as “Peeping Tom”.
