5th Degree Controlled Substance - Possession

There are 2 different ways to be charged with 5th degree controlled substance - Possession

1. Schedule I - IV controlled substance

(Minn. Stat. § 152.025 Subd. 2(1))

The possession of schedule I - IV controlled substances (with the exception of cannabis) is a 5th degree controlled substance crime.

2. Fraud or deceit

(Minn. Stat. § 154.025 Subd. 2(2))

Using fraud or deceit to either obtain or attempt to obtain controlled substances is a 5th degree controlled substance crime.
